Florida woman accused of threatening to kill Kamala Harris

“Niviane Petit Phelps knowingly and willfully threatened to kill and cause bodily harm to the Vice President of the United States in violation of Title 18, United States Code Section 871,” from February 13 to 18, according to the complaint.

On March 3, Special Agent David Ballenger was made aware of a threat to kill Harris, according to the complaint. The threats were sent by Phelps to her incarcerated spouse at Wakulla Correctional Facility via JPay, a computer application that enables media sharing between non-incarcerated and incarcerated people.

A special Secret Service agent assigned to the case obtained the videos and photographs sent by Phelps to his wife.

“The videos (relevant to this investigation) generally show Phelps complaining and speaking angrily into the camera of his hatred for President Joe Biden and Vice President Kamala Harris, among others,” the complaint read. “However, in these videos, Phelps also made statements about the murder of Vice President Harris.”

In one of the videos, “Phelps said,” Kamala Harris, you are going to die. Your days are already numbered, ”the complaint added.

In another video from February 18, Phelps said, “I’m going to the shooting range. … I swear to God, today is your day you’re going to die. In 50 days, mark this day,”

Phelps was also shown at a shooting range in a photo dated two days later, according to the complaint. “On February 22, 2021, Phelps applied for a Concealed Weapons License.”

On March 3, Secret Service and Detectives from the Miami-Dade Police Department visited Phelps’ home to attempt to question her, but she refused to speak to them at the time, according to the complaint.

“Two days later I got a call from Phelps complaining that her employer had put her on administrative leave,” read the complaint.

On March 6, a Secret Service agent went to speak with Phelps at her home.

According to the complaint, Phelps said: “At the time, she was angry that Kamala Harris was becoming vice president, but that she is ‘over now.’ Phelps spoke about how she thought Kamala Harris wasn’t actually “ black ” and how, at the inauguration, Kamala Harris disrespectfully got hold of her purse instead of the Bible. Phelps went on to say that someone told him America was going to choose who they chose, so Phelps put aside his rage over the vice president. Phelps said she was now “outdated”.

CNN has reached out to public defender for Phelps for comment.
